Kentucky Housing Corporation has on its Web site house plans available free of charge to any person(s) who wishes to utilize them. The designs can be modified as needed and are not necessarily the final design. Kentucky Housing staff will not add to or modify plans. It is the responsibility of the person(s) using these plans to find their own designer or architect to make any changes.

In addition, it is important to note that Kentucky Housing is not liable for the structural integrity of any home built from these plans. Kentucky Housing disclaims all warranties, expressed or implied, including merchantability or fitness of purpose. PRIVACY POLICY (updated 2/25/2008)

Kentucky Housing Corporation (referred to "KHC" or "We") hereby adopts the following Privacy Policy:

Customer's Right to Privacy

KHC understands and respects our customers' right to privacy and our obligation to keep any and all customer information confidential. It is important for you to know that KHC does not sell customer information. We have developed and will continue to maintain certain standards to ensure that customer information is secure and private at all times.

Collection, Retention and Use of Customer Information

We collect nonpublic personal information from the following sources:

  • Information provided on applications and other forms such as name, address, social security number and income
  • Information received from credit reporting agencies
  • Information concerning payment history, balances, creditworthiness and credit history

We collect, use and retain customer information when we believe it would be necessary to conduct KHC's business and/or to offer or provide services to our current and prospective customers. KHC does not disclose any nonpublic personal information regarding our customers, past or present, to anyone, except as permitted by law.

Access to Customer Information

Employee access to personal customer information is limited to those with a business reason for knowing such information. Employees are educated in the importance of maintaining customer confidentiality and privacy. We periodically review employee compliance to enhance the protection of customer information.

KHC also maintains appropriate security procedures regarding unauthorized access to customer information as required by applicable laws, regulations and corporate policy.

 

Disclosure of Information to Affiliated and Nonaffiliated Third Parties

We may disclose nonpublic personal customer information to program areas within KHC, when:

  • The customer requests that we do so.
  • The information is provided to help complete a customer-initiated transaction, such as consumer reporting agencies, coupon book vendors, federal insuring agencies, private mortgage insurers, and loss mitigation service providers.

In addition, we may disclose nonpublic personal customer information when the disclosure is allowed or required by applicable law (a subpoena or fraud investigation).

Open Records Requests

Kentucky Revised Statute (KRS) 61.870 and the Open Records Act (ORA) define a public record as "all books, papers, maps, photographs, cards, tapes, discs, diskettes, recordings, software, or other documentation regardless of physical form or characteristics, which are prepared, owned, used, in the possession of or retained by a public agency."

KRS 61.878 specifically itemizes a number of exclusions to which public records may be disclosed. Requested records will be provided in accordance with these exclusions and in accordance with the opinions of the Kentucky Attorney General. In part, the following records are exempt from an information request under KRS 61.878 (1)

1. Public records containing information of a personal nature where the public disclosure thereof would constitute a clearly unwarranted invasion of personal privacy (KRS 61.878 (1) (a) ).

2. Records of law enforcement agencies or agencies involved in administrative adjudication that were compiled in the process of detecting and investigating statutory or regulatory violations, if the disclosure of the information would harm the agency (KRS 61.878(1)(g)).
3. Preliminary drafts, notes and correspondence with private individuals other than correspondence that is intended to give notice of final action of a public agency (KRS 61.878 (1)(h)).

4. Preliminary recommendations and preliminary memoranda in which opinions are expressed or policies are formulated or recommended (KRS 61.878 (1)(j)).

5. Public records or information the disclosure of which is otherwise prohibited by federal law or regulation, and public records or information the disclosure of which is prohibited or restricted or otherwise made confidential by an enactment of the General Assembly (KRS 61.878 (1)(j & k)).
